The increased role of the lawyer in the application for a dematerialized resident permit

The new dematerialization process for residence permit applications highlights a dysfunction of the public service.
The lawyer plays an essential role in guaranteeing foreigners' access to their rights: an explanation illustrated by the story of a client of Maître Clara TRUGNAN.

The observation is clear: foreigners willing to regularize their administrative situation are facing different barriers right from the start of their procedures: making an appointment online to apply for residence permit.

A Moroccan citizen, client of my office wanted to regularize her situation. She had to face those obstacles.
As an example, here is her story.
In July 2020, she decided to start her administrative procedures on the official website of the Prefecture. She wanted to get an appointment for a first demand of residence card.
After several failures, she decided to contact her lawyer :
« I really liked Maitre TRUGNAN from the first time. She was really supportive ».
The assistance of her lawyer played an important role: on one hand, the lawyer assisted her in administrative procedures, on the other hand, the lawyer could bring the case in the administrative court :
- She sent a letter, an email with receipt confirmation to the Prefecture and attached the screenshots of the multiple failures.
- She filed an appeal before the urgent application court in Montreuil .
After this long and intense procedure, the client finally got a convocation to the prefecture, which is really encouraging.

After years of waiting, she will finally apply for a residence permit in the Prefecture.
